Investigating and lobbying against corruption in
Wealden District Council's legal & planning departments

All too often we hear of cases after the dirty has been done. If you suspect your Council are mistreating you, take heart - look at how they treated others on this site and we hope learn from their mistakes.  We may not be able to offer financial support, but you will know you are not alone.  What we can do is to share our practical knowledge.  This may assist you to stand up for your rights in a more informed way.

In our experience, this Council relies on the laypersons ignorance.  Every dirty trick is used to wear down an opponent.  The assistance of other Government departments is solicited to distract you.  You may be forced into a Court fight or Appeal situation, which because of the cost of professional representation, you will be at a disadvantage and at the mercy of the system.  Unfortunately, the system only works effectively for those with the clout to instruct a legal team.  For the rest of us we will have to wait for the law to catch up and meet the promise of a fair hearing for all.

Council's have a duty to be reasonable as established in law by the Associated Picture Houses v Wednesbury Council case 1948.  Unfortunately, all too often officers of a Council go beyond what is reasonable - sometimes fabricating evidence, sometimes demolishing property unlawfully.  They do this to protect their jobs and for a whole host of other reasons, in the full knowledge they will never be prosecuted.  Some even develop a power complex and will go to any lengths just to win a case, perjure themselves or otherwise pervert the course of justice.

Wealden planning dept persuaded a County Court Judge in a planning case to say that Wealden Council 'do not have a duty of care'. The Judge refused to issue his judgment in writing after the case. It seems from the Audit Commission that Wealden have relied on this judgment as a legal precedent for other cases, but they can't manage to produce a copy of it. The Audit Commission are now to investigate at Wealden.

Be under no illusion, what we have described above are serious Crimes.  Judging by the newspapers Planning Crime is rife in England.  The perpetrators are getting away with serious offences because there is no effective legislation or policing to make local authority officers answerable to the Courts.  The cost to affected citizens is far reaching, in some cases costing many thousands of £'s, in others leading to complete ruination contrary to the Human Rights Act and all that is decent.

We advise you to stand up for your rights by lobbying local Councillors (list) and MPs.  Write to your representatives and ask for a change in the law, to prevent the same things happening to other innocent members of the public.

THE TRUTH HURTS

We have been contacted by a BBC reporter regarding the demolition of our original stables by your council. It appears a councillor may have accidentally put a link to pages on the bushywood.com website, which for some reason came to the attention of the media.

Our Chairman was asked if we could substantiate the stories on the site and for the record our spokesperson said the stories were well documented and for the most part in the public domain. In fact most pages quote newspaper articles directly. He pointed out he was a trustee of our charity and the charity was set up to provide a home and care for disadvantaged animals.

Unpalatable as it may be to your members, the content of the bushywood website is factual. However, should there be any matter which has not been correctly reported and your chief executive can provide convincing evidence, then we will be happy to make appropriate corrections with apology.

Meantime, it is correct that your Council is not reporting injustices and findings of maladministration as required by Parliament. For our part we would welcome any initiative to give force back to this important legislation intended as a safety-net to keep the members advised as to mistakes their council is making.

With respect, may we suggest that the simplest way for your council to get back on track would be to dismiss the staff responsible for making your Council law breakers and recruit personnel more sympathetic to the enactments of Parliament.
